TERMS OF BUSINESS

These are the terms and conditions which you agree to by taking part in classes, workshops and personal training at TheBox Ltd.  

Definitions

‘Applicant’ means someone seeking to purchase and use TheBox’s services.

‘Classes and packages’ means all services available for purchase and use at TheBox.  This includes single classes, packages of multiple classes, unlimited class packages, memberships and personal training.

‘Declaration’ means the waiver which all applicants must sign before participating in any activities at TheBox.

‘Personal details’ means the information that must be provided upon registering with TheBox.  This includes name, address, telephone number, email address and emergency contact details.

‘Registration’ means an applicant that has successfully signed up to purchase and use TheBox’s services.

  2. Contacting You

    Unless otherwise provided for in these terms and conditions, if TheBox has to contact you it will do so by telephone, email or post at the contact telephone number, email address and postal address you provide to us.

  3. Health and Safety

    Health and Safety is very important to TheBox.  Therefore, all clients must confirm that they have read and understood the following declaration before undertaking any classes, workshops or personal training with TheBox.

Declaration

  • In consideration of being allowed to participate in the classes and training at TheBox (in the studio, outdoors and online, I acknowledge that:

  • I am aware of and understand the potential risks and dangers associated with physical activity including the use of equipment and I am voluntarily participating in these activities with knowledge of the risks and dangers involved.

  • I understand that exercise and fitness activities involve a risk of injury or even death and that I am voluntarily participating in these activities and using equipment and facilities with knowledge of the dangers involved. I hereby agree and expressly assume all and any risks of injury, illness (including Covid-19) or death.

  • I know of no reason why I should not participate in any of the classes and training at TheBox. To the best of my knowledge and belief I am in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort, wellbeing or physical condition. I agree to inform a member of staff and where appropriate provide written consent from my doctor should such a condition or complaint arise before continuing with any activity, including Covid-19 symptoms.

  • I agree to abide by all oral notices regarding safety whilst at a TheBox class. I am aware I have the opportunity to ask questions about the activities, general use of equipment and other related issues at class. If I choose not to take the advice or to disregard any advice given, I do so voluntarily and accept liability for all resulting injuries, illness (including Covid-19) or damage.

  • I do hereby waive, release and discharge TheBox from any and all responsibility or liability for injuries, illness (including Covid-19) or damages resulting from my participation in any activities or my use of equipment or facilities in the above mentioned activities.

If in any doubt, please seek your doctor’s advice about your suitability to participate in progressive and unrestricted physical activity.

Our Promise

Whilst it is your responsibility look after your health and wellbeing we at TheBox endeavour to do the following:

  • Maintain a safe environment for you to enjoy your exercise.

  • Ensure that our fitness trainers and staff are qualified to fitness industry standards.

  • Keep confidential any information that you give us regarding your health. Finally, whilst we will respect your decision over your training regime we reserve the right to ask you not to exercise beyond what we reasonably believe to be your personal ability.

4. TheBox Registration

No person may participate in any activities at TheBox unless he or she has registered with TheBox.

All clients must ensure that they complete and maintain their personal details in TheBox’s booking system.  This includes as a minimum, full name, telephone number, address, email address and emergency contact details.

A person may only hold, one registration with TheBox at any given time.

Children and young persons under the age of 16 years are not permitted to participate in any TheBox class and accordingly are not eligible for registration except for ‘TheClub’ Children and young persons between the ages 5 and 16 years can participate in ‘TheClub’ and must hold a valid registration and have parental consent. There must be no more than 2 children or young persons under 16 for each adult.

TheBox may require proof of age from any applicant for registration.

TheBox may at any time require any person who has attained the age of 16 years but who is under the age of 18 years to produce a written parental consent.

TheBox can at any time request further information from a client with respect to his or her personal details or physical or mental health or wellbeing.

TheBox may refuse or cancel a registration if it has reason to believe:

(a) the applicant is under the age of 18 years old, but has not provided proof of ID or produced the requested parental consent; or

(b) the applicant has one or more other applications for registration outstanding; or

(c) has not properly completed their personal details, or if any of its content has or may have changed or is or may be incorrect or inaccurate; or

(d) has not acknowledged or signed the declaration, or any of its content has or may have changed or is or may be incorrect; or

(e) the registration of that person, or the participation of that person in any TheBox activity, would or could prejudice or harm TheBox or its business or affairs or any of its other clients, workers, contractors, agents or representatives.

If TheBox refuses an application for registration it will as soon as practicable notify the applicant of the refusal and the reason for it. There is no right of appeal against a refusal, but a refusal does not prevent further applications for TheBox registration.

Following notification of the refusal, any contract between TheBox and the applicant shall terminate, save that any provision of these terms and conditions that expressly or by implication is intended to come into or continue in force on or after termination shall remain in full force and effect.

5. Purchasing TheBox’s Services

In the advertising and marketing material any images relating to a class are for illustrative purposes only. TheBox may from time to time offer certain classes or packages on certain terms to certain groups, and in particular, may offer special introductory offers to new clients, which for the avoidance of doubt may not be available to existing clients or clients who for whatever reason have at any time cancelled their registration and re-registered with TheBox.

From time to time TheBox may need to make minor changes to classes or packages of classes to reflect changes in law and to implement improvements to class content.

Purchases of classes and packages may be made online through the TheBox website or in person, and must be paid for in full by credit or debit card. For the avoidance of doubt, purchases may not be made by email.

Once a purchase has been made for a client using a credit or debit card TheBox will record and keep the details of that card for use in future purchases. If the client does not wish for such details to be recorded and kept in this way, or wishes to make a particular purchase using a different credit or debit card or cash, he or she must notify TheBox of this fact at the time of purchase.

Refunds

TheBox will not refund classes and packages that have been used or started.  Refunds are at TheBox’s discretion.

6. Cancellations

Classes

If you cancel with more than 5 hours’ notice of class, known as an ‘early cancel’, TheBox will not charge you for the class.

If you have purchased a multiple class package, and cancel within 5 hours of class, known as a ‘late cancel’, a class will be deducted from your package.

If you have purchased an unlimited monthly, and cancel within 5 hours of class – known as a ‘late cancel’, TheBox reserves the right to charge you a fee of £6 after the 2nd late cancel during that month

From time to time for various reasons beyond its control, such as injury or illness to a trainer or the unavailability of a venue or studio, TheBox may need to cancel a class that a client is due to attend. TheBox will notify clients’ of the cancellation via email.  

Personal Training

If you cancel with more than 12 hours’ notice of your personal training session, known a an ‘early cancel’, TheBox will not charge you for your session.

If you cancel with within 12 hours’ notice of your personal training session, known as a ‘late cancel’, a session will be deducted from your account (either the single or multiple sessions that have been purchased).

From time to time for various reasons beyond its control, such as injury or illness to a trainer or the unavailability of a venue or studio, TheBox may need to cancel a personal training session that a client is due to attend. TheBox will notify clients’ of the cancellation via email and if possible, telephone.  If the client does not have access to emails then he or she must attend TheBox reception to be given such notification and confirmation in person.

7. Waiting Lists

A purchase of a class or a package does not guarantee that the client will be able to attend any particular class. Classes are filled on a “first come first served” basis, and if a particular class is full or otherwise not available the cost of that class will be held to the credit of the client to be applied to another class to be selected by the client (subject to availability).

Classes will operate with waiting lists.  If a class is full, you can choose to join the waiting list.

More than 6 hours prior to a class starting, if a space becomes available, you will automatically get added from the wait list (and will be notified).  TheBox will assume that unless you tell us otherwise you will attend class.  Late cancel charges may apply.

Less than 6 hours prior to class starting, if a space becomes available, we will manually add you from the waiting list and we will endeavour to notify you by email.  TheBox will assume that unless you tell us otherwise you will attend class.

8. Participation in TheBox Classes

Clients due to participate in a class must arrive at the scheduled venue in good time and be present at the relevant studio ready for participation in the class not later than 15 minutes before the scheduled start time. Clients must check-in to the class at reception.

It is recommended that clients should supply their own hand wraps and boxing gloves for classes that involve boxing.  TheBox will no longer supply boxing gloves for clients to use during classes.

Clients must ensure that he or she wears clothing and footwear appropriate to the class in which he or she is participating, and avoids unsuitable jewellery or other accessories. If the trainer taking the class has reason to believe that any item of clothing or footwear is inappropriate, or any item of jewellery or other accessory is unsuitable, the client will be required to change or remove such item. If the client fails to comply with such a requirement the trainer may require the client to stop all further participation or limit or restrict any further participation as the trainer considers necessary to protect the health and safety of the client, other clients participating in the class, TheBox staff, and any other person for the time being present. If further participation is stopped or limited or restricted, the client will not be entitled to any refund of any of the cost of the class or any other compensation.

If at any time during participation in a class a client suffers any injury or illness (however minor), the client must immediately disclose this fact to the trainer taking the class. Thereafter the client shall provide such further information relating to the injury or illness as the trainer may reasonably request. If the trainer has reason to believe that the client has any injury or illness which with any further participation would or could be a risk to the health and safety of the client, other clients participating in the class, TheBox staff, or any other person for the time being present, the trainer may require the client to stop all further participation or limit or restrict any further participation as the trainer considers necessary to avoid such risk. If further participation is stopped or limited or restricted, the client will not be entitled to any refund of any of the cost of the class or any other compensation.

At the end of a class clients should promptly vacate the studio, taking with them all of their personal belongings and effects. TheBox take no responsibility for clients’ personal belongings or effects at the studio. No lost property will be held on site.

From time to time, TheBox will take photos and video recordings for advertising purposes.  If a client does not wish to participate, they should make this known to the trainer.

At all times during participation in a class a client must do all such acts and things, and comply with all such directions and instructions, which the trainer taking the class considers necessary to protect the health and safety of the client, other clients participating in the class, TheBox staff, and any other person for the time being present.

9. Governing Law

These terms and conditions are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
